当今的社会，离婚已是非常普遍的现象。虽然说离婚不是一件很愉快的事情，但是，当夫妻的感情已经破裂并到了一个无法修复的状态的时，那么离婚也许就是为双方解脱的方法。

 

根据 Law Reform (Marriage and Divorce) Act 1976，已婚夫妇可以通过向法庭提交诉求（Petition）来进行离婚程序。

 

在马来西亚离婚诉求有分成两种类型，分别被称为：-

​

1. 双方面诉求

双方都同意离婚也同意所有离婚的条款，如，子女抚养权、子女探视权、伴侣及子女赡养费及婚姻资产分配。这样就可以通过律师向法庭申请离婚。这类的离婚案件简单、快速及便宜。

​

2. 单方面诉求

如果你的伴侣不同意离婚或不同意所有离婚条款，你就必须单方面申请离婚。那你就需要前往你与伴侣最后居住地区的婚姻注册局里填写相关表格，并等待婚姻仲裁庭通知出席辅导。婚姻仲裁庭会尝试了解你们面对的婚姻问题，如果无法协助你和伴侣挽回你们的婚姻，那么他们将会发出一张你提出离婚申请时所需的证书。你也必须证明单方面提出申请离婚是不是基于以下至少一项情况：

• 你的伴侣有外遇；

• 你伴侣的行为让你无法继续与他/她生活，例如粗暴对待你、对你施暴、忽略赡养你及子女；

• 你的伴侣已经抛弃你至少两年；

• 双方已经分居至少连续两年。

Divorce has been a very common phenomenon in today's society. Although divorce is not a very pleasant thing, when the couple's relationship has been broken and has reached a state beyond repair, then divorce may be the way to release both parties.

 

Under the Law Reform (Marriage and Divorce) Act 1976, married couples can initiate divorce proceedings by filing a Petition in court.

 

There are two types of divorce claims in Malaysia known as: -

​

1. Joint Petition

Both parties agree to divorce and to all the terms of the divorce, such as child custody, child visitation, spousal and child alimony, and division of marital assets. In this way, a lawyer can apply to the court for a divorce. These divorces case is simple, quick, and cheap.

2. Single Petition

If your spouse does not consent to the divorce or does not agree to all the terms of the divorce, you will have to apply for a single petition. You will need to go to the Marriage Registration office where you and your spouse last lived to complete the relevant forms, and wait for the marriage tribunal to notify you to attend counseling. The marriage tribunal will try to understand the marital problems you and your spouse are facing, and if they are unable to help you and your spouse recover your marriage, they will issue a certificate that you need to apply for a single petition. You must also prove that the single petition is based on at least one of the following:

-  Your spouse is having an illegal love affair;

-  Your spouse's behavior makes it impossible for you to continue living with him/her, such as treating you badly, being violent to you, neglecting to support you and your children;

-  Your spouse has abandoned you for at least two years;

-  You and your spouse have been separated for at least two years.
